Terms of Use

ARTICLE 1
APPLICATION

The following general terms of transaction apply to all contracts entered into by the company PALAIOLOGOS P. & SIA O.E (hereinafter referred to as Kärcher Center Palaiologos) with consumers (hereinafter referred to as customers) within the framework of the online-shop electronic store. A consumer is considered to be a natural person who acts in their own name and for purposes that do not fall within their commercial, business, craft, or freelance professional activity.

Orders and deliveries pertain to and are made within the territory of Greece, and transactions will be conducted in the Greek language. Customers outside the territory of Greece are kindly requested to refer to the Kärcher online-shops in their own country (information available at www.karcher.com).

ARTICLE 2
Conclusion of a Sales Agreement for Products

The counterparty of the customer is the company with the trade name ‘PALAIOLOGOS P. & SIA O.E.’, which is referred to below as ‘Kärcher Center Palaiologos.’

The products offered and displayed on the online shop (devices, accessories, cleaning products for private use, etc.) constitute a non-binding offer for the customer to place a purchase order. The customer is informed about the availability of the products through corresponding indications. The website of the online store includes products that are available and products marked as ‘currently unavailable.’ Additionally, product offers displayed on the online store are always valid until the stock is exhausted.

Items can be selected from the offered products, which will be added to the shopping cart, and then the order will be placed with Kärcher Center Palaiologos. Before submitting the order, the customer has the option to review all order details (e.g., product description, quantity – number of ordered items, customer name, address, payment method) and make any necessary changes. As soon as the customer clicks on the ‘place order’ section (box) with the indication ‘order submission,’ the customer provides Kärcher Center Palaiologos with a binding offer for the conclusion of the sales agreement. The receipt of the customer’s order is immediately confirmed with an electronic message (email) as an order confirmation. The aforementioned order confirmation does not constitute acceptance of the customer’s offer. The sales contract is concluded and becomes effective upon the dispatch of the ordered item to the customer. Before sending the product, an email is sent to the customer confirming the shipment, which is attached to the sales invoice or invoice.

The customer can print or save the contents of the order immediately after submitting the order. Additionally, the customer can view this information by selecting the ‘MyKÄRCHER’ section. With the confirmation of the customer’s order, access to the terms of the agreement, including the general terms of transaction, is provided to the customer, which are made available and remain at the customer’s disposal.

Kärcher Center Palaiologos is entitled to limit the quantity/pieces of the order to the usual amount for household use. This applies to both the pieces of the ordered items based on the same order and multiple orders (consecutive or not) of the same items, the quantity and pieces of which exceed the usual amount for household use.

ARTICLE 3
Right of Withdrawal Information

1. Customer’s Right of Withdrawal
In every distance selling contract concluded through the online-shop electronic store, the customer has the right to withdraw without giving any reason, verbally or in writing, within fourteen (14) calendar days pursuant to Article 3 of Law 2251/1994 on consumer protection. To exercise the right of withdrawal, the aforementioned fourteen (14) calendar days begin for goods from the day of their receipt and for services from the date of the conclusion of the corresponding contract.

The consumer-customer exercises the right of withdrawal by notifying it in writing or by any other durable medium made available to the recipient-supplier company for the latter to become aware of the withdrawal. The notification of withdrawal by the consumer from the distance contract must be made to the following address:

2. Consequences of Withdrawal
The consumer-customer is obliged to return the product in its original condition within 14 calendar days from the day on which he/she informed Kärcher Center Palaiologos of his/her decision to withdraw from the contract, bearing only the cost of returning the product. Specifically, the products must be returned in the original condition in which they were received by the customer, unused. In all cases, the return of the product must be made with all the documents accompanying the product (e.g., purchase receipt such as a retail receipt, accompanying documents, etc.) with all its accessories and packaging in perfect condition. In the event of product return, and provided that the products have been previously received and inspected by Kärcher Center Palaiologos, the refund to the customer will be made with the care of Kärcher Center Palaiologos. In the case of cash payment, if the customer had selected the option ‘pick up from the store,’ the refund will be made to the customer by the store from which the returned product was collected. In the event that the products are returned damaged or incomplete, Kärcher Center Palaiologos has the right to refuse the return of the products, which should have been returned in their original condition, thereby excluding the consumer’s right of withdrawal.

In the event of exercising the right of withdrawal by the consumer as described above, Kärcher Center Palaiologos is obliged to refund the amounts paid by the consumer within 14 calendar days from the day on which the consumer was informed of the consumer’s decision to withdraw from the contract pursuant to Article 3θ of Law 2251/1994. However, in accordance with the third paragraph of the same article, Kärcher Center Palaiologos retains the right to withhold the refund until it has received the products back or until the consumer provides evidence that the products have been returned.

ARTICLE 4
Prices, shipping costs

The prices listed on the online-shop electronic store include the legal Value Added Tax (VAT), while shipping costs are not included.

Shipping Costs
For shipments weighing up to 30 kg with GENIKI TACHIDROMIKI, the shipping cost is €3.00 regardless of weight or distance. For shipments of goods weighing 30 kg and above, the shipping cost will be determined after consultation.

For the delivery of products to customers within Attica (excluding the islands of the Argosaronic Gulf), shipping costs of €10.00 apply. Shipping costs are communicated to the customer before they place their order. In cases where the value of the order exceeds €150.00 including VAT, no shipping costs will be charged.

For shipments to provinces, the delivery to the customer’s agent is covered by our company. From the agent to the customer’s location, the customer is responsible for the shipping cost.

ARTICLE 5
PAYMENT

The customer has the right to choose the method of payment for the purchase price, either in cash, as an advance payment, or by cash on delivery.

Payment in Cash
Payment of orders can be made in cash when the customer selects the “payment and pickup from the store” option.

Payment by Cash on Delivery:
Cash on delivery cost: €4.00 with GENIKI TACHIDROMIKI for shipments of goods up to €300 in value.
For all orders with cash on delivery, a telephone confirmation will follow.

ARTICLE 6
Ownership retention

Until the full payment of the purchase price for the delivered products, Kärcher Center Palaiologos retains ownership of them and is entitled to request their return from the customer, even by seeking protective measures if they are not paid for.

ARTICLE 7
DELIVERY

Kärcher Center Palaiologos is entitled to make partial deliveries.

In the event of Kärcher Center Palaiologos being unable to deliver the ordered product to the customer for reasons attributed to its own supplier, Kärcher Center Palaiologos is entitled to cancel the customer’s order. In this case, Kärcher Center Palaiologos will promptly inform the customer of its inability to deliver the product and refund any advance payment received. The customer will retain their legal rights.

The availability of products is indicated next to their description with the following indications:
(a) green indication: the product is immediately available
(b) yellow indication: the product is available in a short period, at the latest within five working days
(c) red indication: the product is not currently available.

If one of our products is not included in the online-shop, please contact us directly or our nearest commercial partner.

Delivery deadlines are indicative and do not constitute a fixed time frame, as there may be deviations in timing.

ARTICLE 8
Addition, Deposit

The customer is entitled to set-off their similar claims against the claims of Kärcher Center Palaiologos, provided that their claim is clear and has been conclusively judged or is undisputed and explicitly recognized by Kärcher Center Palaiologos. The customer also has the right of retention if their claim is based on the same legal relationship.

ARTICLE 9
deficiencies - deficiencies of specified qualities

For the handling of defects or deficiencies in the sold products, the provisions of the civil code apply. In order for a property to be considered as agreed upon, it must be certified in writing by both parties.

The above rights expire within two years from the delivery of the product.

The following are not considered defects:

  • Normal or natural wear and tear.
  • Damage or loss due to improper or unlawful use, improper storage, assembly and use contrary to the provided instructions, excessive wear and tear, poor maintenance, or care after the transfer of risk (delivery) to the customer.
  • Damage or loss due to force majeure or an external event that could not be foreseen, or unusual use of the product.

ARTICLE 10
safe products - Warranty terms

The available Kärcher products are long-lasting products (durable consumer goods), except for cleaning products considered consumables, which bear all necessary safety certifications. The products are accompanied by written, clear instructions for safe use, maintenance, upkeep, and full utilization, as well as information about the risks during use and maintenance (except for simple product construction, use, and maintenance) and a written warranty of good operational condition of a reasonable duration, commensurate with the possible product lifespan, in the Greek language. The warranty document always includes the name and address of the guarantor, the product covered by the warranty, its exact content, its duration, the territorial scope of its validity, as well as the rights provided by applicable law. The device’s warranty has a reasonable duration in relation to the possible product lifespan and allows for free resolution of any issues, provided the following conditions are met:

  • The Kärcher warranty and the proof of device purchase exist.
  • The essential elements of the device (Serial No.) have not been altered.
  • Damage is not excluded based on the manufacturer’s warranty document.

ARTICLE 11
Compensation, limitation of liability

The Kärcher Center Palaiologos is only responsible for compensation in cases of intent and gross negligence. The Kärcher Center Palaiologos is liable for slight negligence only when it breaches a material obligation on which the customer’s smooth fulfillment of the contractual provision exclusively depends, and which the customer is entitled to rely on. Otherwise, liability for any other compensation, even for pre-contractual liability, is excluded, subject to the provisions of the law.

In the event of liability of Kärcher Center Palaiologos due to slight negligence, liability is limited to the damage that Kärcher Center Palaiologos could have foreseen and estimated at the time of entering into the contract, according to the circumstances known at that time.

The aforementioned cases of exclusion and limitation of liability of Kärcher Center Palaiologos do not apply if Kärcher Center Palaiologos has provided a warranty, or when the damages are due to violations of life, physical integrity, or health, or when claims are based on product safety legislation.

The aforementioned cases of exclusion and limitation of liability also apply in favor of our partners, fulfillment assistants, and other third parties whom Kärcher Center Palaiologos uses in the fulfillment of its contractual obligations.

ARTICLE 12
Data storage and data protection

The Kärcher Center Palaiologos requests and stores the necessary customer information for order processing. During the processing of personal data, Kärcher Center Palaiologos takes into account and complies with the legal provisions regarding the protection of personal data. For more details, you can refer to the “Security and Personal Data” section.

ARTICLE 13
Applicable Law - Competent Courts

The general terms of the transaction are governed by the provisions of Greek law, and the provisions of the ‘United Nations Convention on Contracts for the International Sale of Goods,’ as ratified under Law 2532/1997, do not apply.

The contract drafted between Kärcher Center Palaiologos and the customer includes all agreements, and there are no other oral agreements.

For any disputes arising from these general terms of transaction as well as the transaction between Kärcher Center Palaiologos and the customer, the courts of Athens shall have jurisdiction.
